I know what it feels like to wait for a decision in uncertainty

While studying in the USA at the University of Wisconsin-Parkside, I was an immigrant myself for 4 years. I know what it feels like to build a life in a new country and how many questions arise every day - where to look for information, who to ask for help, how long to wait for a decision, and what rights you have. I have always played football - in the United States, I played on teams with Latinos who supported me from the beginning and treated me like a member of their family. Thanks to them, I saw firsthand how complicated and stressful administrative matters can be for people living outside their home country and how often formal procedures make it difficult to visit loved ones.

Today, I have many friends from all over the world, and professionally, for over 10 years as an HR Director, I have been hiring people from different countries. For a decade, I have observed how administrative procedures work and how overwhelming months of waiting for a decision can be for people. I personally understand the uncertainty that comes with dealing with formalities in a foreign country. How much time does the office have? (and why it is not that simple)

Before you assess whether the office is late, check when its deadline actually starts. This is the most common misunderstanding in residence cases.

Hook: The 60-day deadline does not run from the date of application, but from the latest of three events: personal appearance (fingerprints), supplementation of formal deficiencies, or submission of documents requested by the voivode.

Correcting the myth

Online, there is information about "90 days for permanent residence". The law says otherwise: for permanent residence and EU resident, the deadline is 6 months. 90 days applies to the appeal proceedings before the Head of UdSC.

Why you wait longer: suspended deadlines

Practice diverges from the law because since 2022, Art. 100d of the Ukrainian special act applies: the running of deadlines for residence cases is suspended. After the amendment of Jan 23, 2026, the suspension lasts until March 4, 2027. In this regard, the voivode has no formal obligation to meet the deadlines in the table above.

Ukrainian citizen (special act)

Suspension applies. It is difficult to allege inaction, and a reminder usually won't speed up the case.

Citizen of another country

Art. 100d should not apply. The statutory deadlines run, and after they expire, a reminder and complaint have real grounds.

The average duration of proceedings before the Provincial Administrative Court from the date of filing a complaint is approx. 3 months.

The Provincial Administrative Court in Gdańsk, having heard in camera under the simplified procedure on 29 May 2025 the case brought by N. S. concerning the failure to act and the excessive length of proceedings of the Voivode of Pomerania in the matter of granting a temporary residence permit orders the Voivode of Pomerania to examine the applicant N. S.'s application within 30 days of the date on which a copy of the final judgment together with the administrative files is served on the authority; finds that the failure to act and the excessive length of the proceedings conducted by the Voivode of Pomerania constituted a flagrant breach of the law; awards the applicant N. S. a sum of money of PLN 2,500 (two thousand five hundred) payable by the Voivode of Pomerania; dismisses the complaint in the remaining part; orders the Voivode of Pomerania to pay the applicant N. S. the amount of PLN 597 (five hundred and ninety-seven) as reimbursement of the costs of the proceedings.

The Provincial Administrative Court in Gdańsk, having heard in camera under the simplified procedure on 8 July 2021 the case brought by K. V. K. concerning the excessive length of proceedings conducted by the Voivode in the matter of granting a foreigner a temporary residence permit finds that the Voivode conducted the proceedings with excessive delay; finds that the excessive length of the proceedings constituted a flagrant breach of the law; awards the applicant K. V. K. a sum of money of PLN 5,000 (five thousand) payable by the Voivode; orders the Voivode to pay the applicant K. V. K. the amount of PLN 597 (five hundred and ninety-seven) as reimbursement of the costs of the proceedings.
